Welcome to AutoAssist Club ("Company", "we", "us"). By enrolling in any AutoAssist Club membership plan, accessing our website at autoassistclub.com, or using our mobile application, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

1. Membership Enrollment & Eligibility

AutoAssist Club memberships are available to residents of the United States aged 18 years or older. Eligible vehicles include personal-use automobiles, trucks, and SUVs manufactured in model year 2000 or later, with an odometer reading of 150,000 miles or fewer at the time of enrollment.

Commercial vehicles, fleet vehicles, motorcycles, RVs, and vehicles used for ride-sharing platforms are ineligible. By enrolling, you represent that all information provided — including vehicle make, model, year, and mileage — is accurate and complete. Misrepresentation may result in immediate cancellation of coverage without refund.

2. Coverage & Benefits

Coverage terms vary by membership tier (Starter, Shield Pro, Elite Armor) as detailed in your individual Membership Agreement provided at enrollment. Coverage becomes effective 24 hours after enrollment confirmation and remains active as long as your membership account is in good standing.

Roadside assistance benefits — including towing, lockout service, fuel delivery, and battery jump-start — activate immediately upon enrollment confirmation, not subject to the 24-hour waiting period.

AutoAssist Club shall not be liable for pre-existing conditions, damage resulting from neglect or abuse, routine maintenance items (oil changes, brake pads, filters, wipers), cosmetic damage, or failures caused by unauthorized modifications to the vehicle.

3. Claims Process

To initiate a mechanical breakdown claim, you must contact AutoAssist Club prior to any repair work being performed. Claims submitted after repairs have been completed without prior authorization will not be reimbursed. We reserve the right to require a diagnostic report from a licensed repair facility before approving any claim.

Upon claim approval, AutoAssist Club will pay the repair facility directly for covered components and associated labor. You are responsible for any non-covered items, applicable deductibles (unless the $0 deductible upgrade is active), and sales taxes as applicable by your state.

4. Billing & Payment

Monthly membership fees are billed on a recurring basis to the payment method on file, on the same calendar date each month. Annual plans are billed in full at the time of enrollment. Failed payments will result in a 10-day grace period, after which coverage may be suspended until full payment is received. AutoAssist Club reserves the right to adjust pricing with 60 days' advance written notice to your email address on file.

5. Cancellation & Refunds

You may cancel your membership at any time without a cancellation fee by logging into your account, calling 1-800-555-AUTO, or emailing support@autoassistclub.com. Members who cancel within 30 days of initial enrollment and have filed no claims are entitled to a full refund of all premiums paid. No prorated refunds are issued for partial months under month-to-month plans.

6. Plan Transferability

AutoAssist Club memberships are transferable to a new vehicle owner upon sale of the covered vehicle, subject to a $50 administrative transfer fee and verification of the new owner's eligibility. Coverage may also be transferred to a replacement vehicle owned by the same member. Transferred plans retain their original expiration terms and remaining benefit limits.

7. Limitation of Liability

AutoAssist Club's total liability for any single claim shall not exceed the actual cost of covered repair services, up to the plan's maximum benefit limits. We shall not be liable for incidental, consequential, special, or punitive damages arising from any claim or denial of coverage, including but not limited to lost wages, alternative transportation costs beyond covered rental benefit, or property damage unrelated to the covered breakdown.

8. Dispute Resolution

Any disputes arising from or relating to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA), conducted in the State of Delaware, under its Commercial Arbitration Rules. By agreeing to these Terms, you waive your right to a jury trial and to participate in class action lawsuits related to our services.

9. Amendments to Terms

AutoAssist Club reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification with at least 30 days' advance notice before the effective date. Continued use of our services after the effective date constitutes your acceptance of the amended Terms.

10. Governing Law

These Terms shall be governed exclusively by the laws of the State of Delaware, without regard to its conflict of law principles. AutoAssist Club LLC ("we", "our", "us") is committed to protecting the privacy of our members and website visitors. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit autoassistclub.com or enroll in one of our membership plans.

1. Information We Collect

Personal Identification: Full name, email address, phone number, mailing address, date of birth, and driver's license number (for claim verification purposes).

Vehicle Information: Make, model, year, VIN, current odometer reading, and service history as provided by you or collected via our optional OBD-II diagnostic device.

Payment Information: Billing address and transaction records. All payment card data is collected and stored exclusively by our PCI-DSS Level 1 compliant payment processor. We never store full credit card numbers on our own servers.

Usage Data: IP addresses, browser type and version, pages visited, time spent on pages, referring URLs, and device identifiers — collected automatically through cookies and similar technologies when you use our website or app.

2. How We Use Your Information

• Process and manage your membership enrollment and renewals
• Administer mechanical breakdown claims and dispatch roadside assistance
• Communicate with you regarding your coverage, claims status, and service updates
• Improve and personalize our website, mobile app, and service offerings
• Comply with applicable legal and regulatory obligations
• Detect and prevent fraud, unauthorized access, and abuse
• Send promotional offers and newsletters only where you have explicitly opted in

3. Sharing of Your Information

We do not sell, rent, or trade your personal information to third-party marketers. We may share your information with: licensed repair facilities and towing providers strictly to fulfill your claim or roadside request; payment processors operating under strict data handling agreements; analytics providers (such as Google Analytics) using anonymized, aggregated data only; and legal or regulatory authorities when required by law or court order, or to protect our legal rights.

4. Cookies & Tracking Technologies

We use first-party and third-party cookies, web beacons, and pixel tags to maintain session state, remember your preferences, analyze site traffic, and serve relevant advertisements. You may disable or restrict cookies through your browser settings; however, some features of our website and member portal may not function correctly without them. We honor Do Not Track (DNT) browser signals for analytics tracking but not for strictly necessary session cookies.

5. Data Retention

We retain your personal information for as long as your membership remains active and for up to 7 years thereafter for legal, tax, insurance regulatory, and audit compliance purposes. Vehicle diagnostic data collected via our OBD-II device is retained for 36 months after membership cancellation, after which it is permanently and securely deleted from our systems.

6. Your Privacy Rights

Depending on your state of residence, you may have the right to:

• Access and receive a copy of the personal information we hold about you
• Correct or update inaccurate information in your member profile
• Request deletion of your personal data (subject to legal retention requirements)
• Opt out of marketing communications at any time via the unsubscribe link in any email
• For California residents: the rights provided under the California Consumer Privacy Act (CCPA), including the right to know what data is collected, the right to delete, and the right to opt out of the sale of personal information
• For Virginia, Colorado, and Connecticut residents: additional rights under applicable state privacy laws

To exercise any of these rights, email privacy@autoassistclub.com. We will acknowledge your request within 5 business days and fulfill it within 30 days, as required by applicable law.

7. Data Security

We implement industry-standard technical and organizational security measures including 256-bit TLS/SSL encryption for all data in transit, AES-256 encryption for sensitive data at rest, optional two-factor authentication for member accounts, role-based access controls limiting employee data access to only what is necessary, and annual third-party penetration testing. No method of data transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Children's Privacy

Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we discover that personal information from a person under 18 has been provided to us without parental consent, we will promptly delete such information from our records.

9. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will notify you of material changes by posting the updated policy on our website with a revised "Last updated" date and, where required by applicable law, via email notification to your address on file at least 30 days before the changes take effect.
